Terms of trading

V.A.T. (Value Added Tax)

V.A.T. at the current rate of 20% in the U.K. will be added to all orders with a delivery address in the U.K. or any of the 27 member countries of the European Union.

Delivery

All items will be sent by Royal Mail first class small packet or 'Recorded Signed For' for UK orders and 'International Signed For' for overseas orders at the price indicated when an online order is placed. For higher value items, Azumi and David (A‘N’D) will add extra insurance cover, but this amount will be included in the item price and the customer will only be charged for the basic ‘Special Delivery Next Day / International Signed For’ rate as indicated on the online order form. We do not normally deliver at the weekend or on Public holidays. Please inform us if you have a preferred delivery date or special requirement and we will attempt to meet your needs. We will confirm receipt of your order by email. At peak periods, especially Christmas, there may be some delay with delivery. Please indicate any urgent orders in advance. **If you want to order several items at once, please email customer@azumianddavid.com for a multi-buy delivery quote, which may work out cheaper.

Returns

If you are not entirely happy with your purchase, you must contact us in writing within 10 days of receipt for an exchange or before you return items to A'N'D for a refund. All goods returned must be as new and the responsibility for the return delivery costs lie with the customer. Upon return the goods will be inspected and a refund made within 10 days.

Damaged goods

Please report any damages or non-delivery immediately - no complaints for transit damage can be considered unless made in writing within 10 days of receipt of goods.

Any claim for damaged or defective goods can only be entertained if the goods are returned to A'N'D in their original packaging or similar suitable packaging to ensure sufficient protection in transit.

Faulty goods, warranties and liabilities

Subject to conditions and provided the total price has been paid by the due date for payment, A'N'D warrants that the Goods will correspond with their specification at the time of delivery and will be free from defects in material (excluding natural markings on materials e.g. leather) and workmanship. A'N'D will (at its own choice) either replace, repair, or give credit for Goods found to be faulty within A'N'D's warranty period relevant to Goods of that type. Unless otherwise stated the standard warranty period for all goods supplied by A'N'D will be 3 weeks from the date of purchase.

A'N'D will as far as possible endeavour to ensure that all goods supplied are safe and compliant with any relevant standards with regard to the specific intended and stated use for the goods. A'N'D cannot be held responsible for defects arising from misuse or mishandling of goods. Any fault or damage to the goods supplied should be reported to A'N'D immediately, failure to do so may affect the warranty.

The Customer will indemnify and keep indemnified A'N'D against all claims, proceedings, costs and expenses in connection with any third party claim based upon any allegation that the safety of the Goods (or materials or components comprised within the Goods or any goods in which the Goods are incorporated) is not such as persons are generally entitled to expect, save where such deficiency in their safety was present at the time the Goods were dispatched to the Customer or its agents by A'N'D or its agents.

A'N'D are responsible for ensuring that goods are adequately packaged for safe transportation of goods supplied.

Retention of title

All products supplied to the Customer by A'N'D, shall remain the sole and absolute property of A'N'D, both in law and equity until the Customer shall have paid to A'N'D the agreed price, together with the full price of any other products supplied by A'N'D, pursuant to any other contract between them. The Customer's right to possession of the products shall cease if it does anything or fails to do anything which would entitle a receiver to take possession of any assets or which would entitle any person to present a petition for winding up (or in case of a person or firm commit an act of bankruptcy). Notwithstanding the retention of property by A'N'D in accordance with the above provisions, all products supplied by A'N'D shall be at risk of the Customer as soon as they are delivered to the Customer's premises or otherwise to order.

Privacy Policy

No customer information will be passed on to any other party or organisation by A'N'D without prior written consent from the customer.

Changes to terms

These terms are variable and subject to change without notice and A'N'D reserve the right to vary these terms from time to time as we see fit. Furthermore these terms may be withdrawn without notice and may vary from contract to contract. A written copy of our current terms is available upon request.
